20/12/2011 - Proposed inheritance rules changes to help unmarried couples

Recently published Law Commission Proposals could help the partners and children of people who die without a Will.

The new proposals include giving more rights to a surviving partner and children of unmarried couples and removing the complicated ‘life interest trusts’ arrangements imposed on husbands and wives in favour of a simpler form of share in estates.

Current rules date back to 1925 and although more recent legislation has allowed family members to challenge the strict position of the rules, the new recommendations will help people living together when their partner dies.
